The California Court of Appeal’s recent decision in Spears v. Spears created a statewide cascade of consternation and confusion about the ruling and its effect upon both trust law and judgment enforcement. Adam discussed the effect and implications of the case holding as well as the recommended best practices of creditors when engaged in post-mortem debt collection and judgment enforcement efforts.
